The Law on Texas DWI

What are the Penalties for DWI/DUI in Texas?
First Offense
- A fine of up to $2,000
- Three days to 180 days in jail
- Loss of driver license up to a year
- Annual fee of $1,000 or $2,000 for three years to retain driver license
Second Offense
- A fine of up to $4,000
- One month to a year in jail
- Loss of driver license up to two years
- Annual fee of $1,000, $1,500 or $2,000 for three years to retain driver license
Open Container
- An additional fine of up to $500 per open container can be levied to the driver and any passenger that possesses an open beverage container that contains alcohol.
Automatic License Revocation (ALR)
- Texas has several different tools at its disposal to enforce its DWI laws. ALR is one of those tools that is used to encourage drivers to submit to tests of BAC.
