Nebraska DUI Penalties | Consequences of Drunk Driving in Nebraska : Jail Time, Fines, License Suspension

 

First DUI (Class W Misdemeanor):

  • Imprisonment: 7 days mandatory minimum - 60 days
  • Fines: $400 - $500
  • Driver's License Revocation: 6 months
  • Alcohol Assessment: Required for first and subsequent DUI arrests
  • If Probation: 60 day license revocation, $400 fine. If BAC .15 or Higher:  1 year license revocation, 2 days in jail or minimum 120 hours community service, $500 fine

Second DUI (Class W Misdemeanor):

  • Imprisonment: 30 days mandatory minimum - 90 days
  • Fines: $500
  • Driver's License Revocation: 1 year
  • Vehicle Immobilization: Required for second and subsequent DUI violations. 5 days - 8 months. 
  • Ignition Interlock Device or Continuous Alcohol Monitoring Device (SCRAM): May be required as an alternative to vehicle immobilization. 
  • If Probation: 10 days in jail or not less than 240 hours of community service, 1 year license revocation, $500 fine

Second DUI with BAC .15 or Higher (Class I Misdemeanor):

  • Imprisonment: 90 days mandatory minimum - 1 year
  • Fines: $1,000
  • Driver's License Revocation: 15 years
  • If Probation: 30 days in jail, 1 year - 15 years license revocation or impoundment, $1,000 fine

Third DUI (Class W Misdemeanor): 

  • Imprisonment: 90 days mandatory minimum - 1 year
  • Fines: $600
  • Driver's License Revocation: 15 years
  • If Probation: 30 days in jail, 2 - 15 year driver's license revocation, $600 fine

Third DUI with BAC .15 or Higher (Class IIIA Felony):

  • Imprisonment: 180 days mandatory minimum - 5 years
  • Fines: Up to $10,000
  • Driver's License Revocation: 15 years
  • If Probation: 60 days in jail, 5 - 15 year license revocation, $1,000 fine

Fourth DUI (Class W Misdemeanor):

  • Imprisonment: 180 days mandatory minimum - 5 years
  • Fines: Up to $10,000
  • Driver's License Revocation: 15 years
  • If Probation: 90 days in jail, 15 year driver's license revocation, $1,000 fine

Fourth DUI with BAC .15 or Higher (Class III Felony):

  • Imprisonment: 1 year mandatory minimum - 20 years
  • Fines: Up to $25,000
  • Driver's License Revocation: 15 years
  • If Probation: 120 days in jail,15 year license revocation, $1,000 fine

Fifth DUI (Class III Felony):

  • Imprisonment: 1 year - 20 years
  • Fines: Up to $25,000
  • Driver's License Revocation: 15 years
  • If probation: 180 days in jail, 15 year license revocation, $1,000 fine

Fifth DUI with BAC .15 or Higher (Class II Felony):

  • Imprisonment: 1 year mandatory minimum - 50 years
  • Driver's License Revocation: 15 years
  • If Probation: 180 days in jail, 5 - 15 year license revocation, $1,000 fine
