Arizona DUI Penalties | Consequences of Drunk Driving in Arizona : Jail Time, Fines, License Suspension
First DUI (above .08% BAC):
- Imprisonment: 10 to 180 days in jail. Minimum of 10 consecutive days in jail. The court may suspend 9 of the 10 days if you agree to undergo alcohol and/or drug evaluation and submit to treatment.
- Fine: Approximately $1,800 plus jail costs
- Driver's License Suspension: 90 days. May be eligible for work/school permit after 30 days of suspension
- Ignition Interlock Device: 12 months
- MADD Victim Impact Panel: Required
- Community Service: May be ordered in addition to any other penalty imposed
- Probation: May be placed on probation for up to 5 years
First DUI - "Extreme DUI" (above .15% BAC):
- Imprisonment: 30-180 days in jail. Minimum of 30 consecutive days in jail. The court may suspend 20 of the 30 days if you successfully complete all recommended counseling and education.
- Fine: $3,000 plus jail costs
- Driver's License Suspension: 90 days. Eligible for work/school permit after 30 days of suspension.
- Ignition Interlock Device: 12 months after reinstatement
- MADD Victim Impact Panel: Required
- Community Service: May be imposted
- Probation: May be placed on probation for up to 5 years
First DUI - "Super Extreme DUI" (above .20% BAC):
- Imprisonment: 45-180 days in jail. Minimum of 45 consecutive days in jail. The court is not permitted to suspend any of the minimum 45 days in jail.
- Fines: Approximately $3,250 in fines plus jail costs.
- Driver's License Revocation: 90 day suspension. May be eligible for work/school permit following first 30 days of suspension.
- Ignition Interlock Device: 18 months after reinstatement
- MADD Victim Impact Panel: Required
- Community Service: May be required
- Probation: May be placed on probation for up to 5 years
Second DUI (above .08% BAC):
- Imprisonment: 90-180 days in jail. Minimum of 90 days in jail. The court may suspend 60 of the 90 days in jail if you agree to undergo alcohol and/or drug evaluation and submit to treatment.
- Fines: Approximately $3,750 plus jail costs
- Driver's License Revocation: 1 year. Reinstatement is not automatic. Not eligible for work/school permit during period of revocation.

Second DUI - "Extreme DUI" (above .15% BAC):
- Imprisonment: 120-180 days in jail. Minimum of 120 consecutive days in jail. The court may suspend 60 of the 120 days if you agree to undergo alcohol and/or drug evaluation and submit to treatment.
- Fines: Approximately $3,750 plus jail costs
- Driver's License Revocation: 1 year. Reinstatement not automatic. Not eligible for work/school permit during period of revocation.
- Ignition Interlock Device: 12 months after reinstatement

- Community Service: 30 hours mandatory

Second DUI - "Super Extreme DUI" (above .20% BAC):
- Imprisonment: 180 days mandatory of which 90 days must be served consecutively.
- Fines: Approximately $4,000 plus jail costs.
- Driver's License Revocation: 1 year. Reinstatement not automatic. Not eligible for work/school permit during period of revocation.
- Ignition Interlock Device: 24 months after reinstatement
- MADD Victim Impact Panel: Required
- Community Service: 30 hours mandatory
- Probation: May be placed on probation for up to 5 years
Third DUI within 5 years; DUI with License Suspended or Restricted; DUI while Person Under Age 15 in Vehicle (Felony Aggravated DUI):
- Imprisonment: Minimum 4 months imprisonment before eligible for probation, pardon, commutation or suspension of the sentence or release on any other basis.
- Fines: Up to $150,000 in fines plus surcharge and additional $250 assessment to Arizona DUI abatement fund
- Driver's License Revocation: 3 years. Reinstatement not automatic. Not eligible for work/school permit during period of revocation
- Ignition Interlock Device: Required
- Vehicle Seizure: If you were operating a vehicle you owned at the time of your arrest, the court may order seizure of your vehicle.
- Probation: You may be placed on probation for up to 5 years.
